Welcome to QwikGrow.

These Terms and Conditions ("Terms", "Terms and Conditions") govern your access to and use of QwikGrow.com, our SMM reseller platform, APIs, reseller tools, white-label services, websites, applications, and related services (collectively, the "Platform").

By creating an account, accessing the Platform, funding your wallet, placing an order, using our API, or otherwise using any QwikGrow service, you agree to be legally bound by these Terms.

If you do not agree with these Terms, you must not use the Platform.

1. About QwikGrow

QwikGrow provides an SMM infrastructure platform that enables resellers, agencies, businesses, and individuals to purchase and resell social media marketing services.

Depending on the services available to your account, QwikGrow may provide:

  • Social media marketing services.
  • Social media engagement services.
  • Automated service fulfilment.
  • Reseller dashboards.
  • Customer management tools.
  • Wallet and account balance functionality.
  • API access.
  • White-label reseller functionality.
  • Branded reseller storefronts.
  • Service pricing and markup functionality.
  • Order management.
  • Service status and tracking.
  • Other related digital services.

The availability of specific services may change from time to time.

2. Eligibility

You must provide accurate information when creating and maintaining your QwikGrow account.

By using QwikGrow, you confirm that:

  • You are legally capable of entering into these Terms.
  • The information you provide is accurate and current.
  • You will keep your account information updated.
  • You will use the Platform only for lawful purposes.
  • You will comply with applicable laws and regulations.
  • You are responsible for activities performed through your account.

If you are using QwikGrow on behalf of a company, organization, or another person, you confirm that you have authority to accept these Terms on their behalf.

3. Account Registration

Certain QwikGrow features require an account.

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • Protecting access to your account.
  • Using strong and secure passwords.
  • Not sharing your account credentials unnecessarily.
  • Not allowing unauthorized persons to access your account.
  • Notifying QwikGrow if you suspect unauthorized access.

You are responsible for activities carried out through your account unless you can demonstrate that the activity occurred through unauthorized access despite reasonable security measures on your part.

4. Reseller Accounts

QwikGrow allows users to operate as SMM resellers.

As a reseller, you may purchase available services from QwikGrow and offer them to your own customers.

You are responsible for:

  • Setting your own customer-facing prices where the Platform allows it.
  • Communicating clearly with your customers.
  • Providing accurate information about your services.
  • Managing your customers and orders.
  • Handling customer support relating to your own business.
  • Complying with applicable laws.
  • Ensuring that your customers do not use your services for prohibited activities.

QwikGrow provides the underlying SMM infrastructure but does not automatically become a party to agreements between you and your customers.

5. White-Label Services

Where available, QwikGrow may allow resellers to operate branded storefronts or services using QwikGrow's underlying infrastructure.

Your use of white-label functionality does not transfer ownership of QwikGrow's software, infrastructure, technology, source code, trademarks, or intellectual property to you.

You may not represent yourself as the owner or developer of QwikGrow's underlying technology unless expressly authorized.

You are responsible for the content, branding, customer communications, pricing, and business practices associated with your reseller storefront.

6. Wallet and Account Balance

QwikGrow may provide a wallet or account balance that can be used to purchase services.

Wallet balances:

  • May be used only for permitted Platform transactions.
  • Are not bank deposits.
  • Do not constitute an investment.
  • Do not earn interest.
  • Cannot be transferred between users unless expressly supported by the Platform.
  • May be subject to applicable restrictions or verification requirements.

You are responsible for ensuring that sufficient funds are available before placing orders.

QwikGrow may impose minimum funding requirements, transaction limits, or other account restrictions where necessary.

7. Deposits and Payments

You may fund your QwikGrow account using payment methods made available through the Platform.

Payment processing may be provided by third-party payment providers.

You agree that:

  • Payment information must be accurate.
  • You must use a payment method you are authorized to use.
  • You must not use stolen, fraudulent, unauthorized, or illegally obtained payment methods.
  • You are responsible for applicable taxes, fees, or charges associated with your transactions.

QwikGrow may delay, reverse, restrict, or investigate transactions where fraud, abuse, unauthorized activity, chargebacks, or other suspicious activity is suspected.

8. Service Pricing and Reseller Profit

QwikGrow may provide reseller pricing for available services.

Where supported, resellers may determine the prices charged to their customers and may establish their own profit margins.

QwikGrow does not guarantee any specific level of profit, revenue, sales, or customer demand.

Service prices may change at any time.

A change in QwikGrow's service price may affect the reseller's potential profit margin.

9. Orders

When you place an order, you authorize QwikGrow to process that order using the information and service selected.

You are responsible for ensuring that:

  • The correct service is selected.
  • The correct quantity is entered.
  • The correct social media link, username, post, profile, or other required information is provided.
  • The submitted information is accurate.
  • The selected service is appropriate for the intended purpose.

Incorrect information submitted with an order may result in delayed, incomplete, failed, or irreversible fulfilment.

10. Service Delivery

QwikGrow uses automated systems and third-party service infrastructure to fulfil many orders.

Service delivery times may vary depending on:

  • The selected service.
  • Service provider availability.
  • Platform conditions.
  • Social network changes.
  • System maintenance.
  • API availability.
  • Order volume.
  • Third-party disruptions.
  • Other technical factors.

Estimated delivery times are not guaranteed unless expressly stated otherwise.

An order may be marked as completed when the service has been fulfilled according to the applicable service parameters.

11. Service Quality and Third-Party Platforms

Many QwikGrow services depend on third-party social media platforms and service providers.

QwikGrow does not control third-party platforms and cannot guarantee that a social media platform will maintain a particular account, post, follower count, engagement level, visibility, or other metric.

Third-party platforms may change their:

  • Algorithms.
  • Policies.
  • APIs.
  • Security systems.
  • Account restrictions.
  • Features.
  • Terms of service.

Such changes may affect the availability or performance of SMM services.

12. Refunds and Order Reversals

Refund eligibility depends on the nature and status of the transaction.

Where an order cannot be fulfilled or is eligible for a refund under our applicable refund rules, the applicable amount may be returned to your QwikGrow wallet or processed through the original payment method where supported.

Orders that have already been successfully delivered may not be eligible for a refund.

We may reject refund requests where:

  • The service was successfully delivered.
  • Incorrect information was provided.
  • The customer changed their mind after fulfilment.
  • The order was affected by actions taken by the customer.
  • The issue resulted from a third-party social platform.
  • The order violated these Terms.
  • Fraud or abuse is suspected.

QwikGrow may investigate disputed orders before determining the appropriate resolution.

13. Chargebacks and Payment Disputes

You agree to contact QwikGrow support before initiating a payment dispute or chargeback where the issue concerns a QwikGrow transaction.

Unauthorized or abusive chargebacks may result in:

  • Account restrictions.
  • Wallet restrictions.
  • Order cancellation.
  • Account suspension.
  • Permanent account termination.

Nothing in this section limits your rights under applicable law.

14. API Access

QwikGrow may provide API access to eligible users.

API users are responsible for:

  • Keeping API credentials secure.
  • Preventing unauthorized API access.
  • Using the API according to applicable documentation.
  • Respecting rate limits.
  • Avoiding excessive or abusive requests.
  • Monitoring API activity.
  • Protecting customer data processed through their integration.

You must not use the API to conduct unlawful activity, attack systems, bypass Platform restrictions, or interfere with QwikGrow's infrastructure.

QwikGrow may suspend or restrict API access where necessary to protect the Platform or other users.

15. Prohibited Activities

You must not use QwikGrow to facilitate, promote, or conduct unlawful, fraudulent, abusive, deceptive, or harmful activities.

Prohibited activities include, but are not limited to:

  • Fraud or scams.
  • Phishing.
  • Malware distribution.
  • Credential theft.
  • Identity theft.
  • Financial fraud.
  • Impersonation.
  • Harassment or threats.
  • Illegal activities.
  • Unauthorized access to accounts or systems.
  • Attempts to bypass security controls.
  • Selling stolen information.
  • Manipulating or attacking QwikGrow systems.
  • Distributing malicious software.
  • Using stolen payment information.
  • Abuse of third-party platforms.
  • Any activity that violates applicable law.

QwikGrow reserves the right to restrict or terminate accounts involved in prohibited activity.

16. Account Suspension and Termination

QwikGrow may suspend, restrict, or terminate an account where we reasonably believe that:

  • These Terms have been violated.
  • Fraudulent activity has occurred.
  • Unauthorized payments have been used.
  • The account presents a security risk.
  • The Platform is being abused.
  • API access is being misused.
  • The account is involved in unlawful activity.
  • The account creates a risk to QwikGrow or other users.

Where appropriate, we may provide notice or an opportunity to resolve the issue.

Termination may result in the cancellation of pending orders and restriction of Platform access.

17. Intellectual Property

QwikGrow and its underlying technology, software, design, branding, interfaces, documentation, databases, and Platform features are protected by applicable intellectual-property laws.

Unless expressly authorized, you may not:

  • Copy QwikGrow's software.
  • Reverse engineer the Platform.
  • Reproduce proprietary components.
  • Extract source code.
  • Resell QwikGrow's technology itself.
  • Remove proprietary notices.
  • Use QwikGrow trademarks without authorization.
  • Create a competing service using unauthorized copies of QwikGrow technology.

Your customer data, business branding, and other materials you lawfully provide to the Platform remain subject to the applicable rights and agreements governing those materials.

18. User Content and Responsibility

You are responsible for information, content, links, branding, descriptions, customer information, and other materials that you submit to the Platform.

You must ensure that your content:

  • Is accurate where accuracy is required.
  • Does not unlawfully infringe another person's rights.
  • Does not contain malicious code.
  • Does not facilitate unlawful activity.
  • Does not violate applicable laws.
  • Does not violate the rights of third parties.

QwikGrow may remove or restrict content that violates these Terms or creates a security, legal, or operational risk.

19. Customer and Data Responsibilities

If you use QwikGrow to provide services to your own customers, you are responsible for handling your customers' personal information appropriately.

You must:

  • Collect only information you are legally permitted to collect.
  • Protect customer information.
  • Use customer information only for legitimate purposes.
  • Comply with applicable data-protection requirements.
  • Provide appropriate privacy information to your customers where required.

Where your use of QwikGrow involves personal data, our Privacy Policy also applies.

20. Availability and Maintenance

We aim to keep QwikGrow available and reliable, but we do not guarantee uninterrupted access.

The Platform may occasionally be unavailable because of:

  • Scheduled maintenance.
  • Emergency maintenance.
  • Server problems.
  • Network failures.
  • Cybersecurity incidents.
  • Third-party service failures.
  • API outages.
  • Internet infrastructure problems.
  • Events outside our reasonable control.

We may modify, suspend, or discontinue features where necessary.

21. No Guarantee of Business Results

QwikGrow provides technology and SMM services but does not guarantee:

  • A specific number of customers.
  • A specific amount of revenue.
  • A specific profit.
  • A particular social media result.
  • A particular level of engagement.
  • A particular number of followers.
  • Account growth.
  • Search or social-media ranking.
  • Viral performance.

Your business results depend on many factors outside QwikGrow's control.

22. Disclaimer

To the maximum extent permitted by applicable law, QwikGrow provides the Platform and services on an "as available" and "as is" basis.

We do not guarantee that every service will always be available, uninterrupted, error-free, or suitable for every purpose.

Third-party services are subject to their own availability, policies, limitations, and technical conditions.

Nothing in these Terms excludes or limits rights that cannot legally be excluded or limited.

23. Limitation of Liability

To the maximum extent permitted by applicable law, QwikGrow and its operators, employees, partners, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, or unforeseeable losses arising from your use of the Platform.

This may include loss of:

  • Profits.
  • Revenue.
  • Business opportunities.
  • Customers.
  • Data.
  • Reputation.
  • Expected social-media results.

Where liability cannot legally be excluded, it will be limited to the extent permitted by applicable law.

24. Indemnification

You agree to defend and indemnify QwikGrow, its operators, employees, partners, and service providers against claims, losses, liabilities, damages, costs, and reasonable expenses arising from:

  • Your violation of these Terms.
  • Your unlawful use of the Platform.
  • Your misuse of QwikGrow services.
  • Your violation of third-party rights.
  • Your customer activities.
  • Your reseller business.
  • Your content or materials.
  • Your violation of applicable laws.

25. Third-Party Websites and Services

QwikGrow may contain links, integrations, APIs, or connections to third-party services.

QwikGrow does not control third-party websites or services and is not responsible for their:

  • Content.
  • Availability.
  • Security.
  • Policies.
  • Terms.
  • Privacy practices.
  • Performance.

Your use of third-party services is subject to the applicable third-party terms.

26. Changes to These Terms

We may update these Terms from time to time.

Changes may be made to reflect:

  • New Platform features.
  • Changes to our services.
  • Changes in business operations.
  • Security improvements.
  • Legal or regulatory requirements.
  • Changes to third-party integrations.

Your continued use of QwikGrow after the effective date of updated Terms constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

These Terms shall be governed by and interpreted in accordance with the applicable laws of the Federal Republic of Nigeria, unless applicable law requires otherwise.

Any dispute arising from or relating to these Terms or your use of QwikGrow shall be handled in accordance with applicable Nigerian law and the jurisdiction of the appropriate courts, subject to any mandatory legal rights available to you.

28. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

29. Entire Agreement

These Terms, together with our Privacy Policy, Cookies Policy, applicable service-specific terms, and other policies expressly incorporated into these Terms, constitute the agreement governing your use of QwikGrow.
